Terms & Conditions and SMS Messaging Policy

1. Business Identity
Each YBX FITNESS Inc.® facility is independently owned and operated.
YBX FITNESS Inc. is a membership-based fitness studio offering boxing, strength training, group fitness classes, open gym access, and personal training services.
By enrolling in any YBX FITNESS Inc. membership, class package, or personal training program, you agree to the terms outlined below.
2. Membership Types & Billing
Month-to-Month Memberships (M2M)
Includes:

YBX Everyday

YBX10
-
YBX5
Month-to-month memberships:
-
Automatically renew monthly
-
Are billed on the same calendar day as the original purchase
-
Continue until properly canceled with 30 days’ advance written notice
YBX10 memberships reload 10 classes per billing cycle.
YBX5 memberships reload 5 classes per billing cycle.
Unused classes do not roll over to future billing cycles.
Term Memberships

Subject to auto-renewal
-
May not be canceled during the initial term except where required by law

Continue until properly canceled per this Agreement
3. Cancellation & Termination

All cancellations require 30 days’ advance written notice or per email (info@ybxfitness.com)

No early termination fee applies to month-to-month memberships
-
Once cancellation notice is received, the membership remains active until the end of the current billing cycle

No refunds are issued for services already rendered
4. Membership Pause Policy

Memberships cannot be paused during the first 3 months
-
After the initial 3 months, memberships may be paused:
-
One month at a time
-
$29 per paused month
-
Maximum of 2 consecutive months
-
Maximum of 4 paused months per 12-month cycle
-
5. Refund Policy
-
No refunds for yearly memberships once started
-
No refunds for personal training packages once started
-
Any refund required by law will be processed within the timeframe mandated by state law
6. Payment Authorization
By enrolling, you authorize YBX FITNESS Inc. and its billing provider (including Mindbody operating under license from TBC International) to initiate recurring EFT or ACH transfers from your designated account for all dues, fees, taxes, and charges owed under this Agreement.
Charges may vary monthly. You will be notified only if a charge differs by more than $50 from your previous payment.
You authorize YBX FITNESS Inc. and its billing partners to contact you regarding billing matters by phone, email, or SMS. Message and data rates may apply.
7. Assumption of Risk & Release of Liability
Participation in fitness activities involves inherent risks, including serious injury or death.
By using YBX FITNESS Inc. facilities, you:

Confirm you are in good health and able to participate

Assume all risks associated with participation

Release YBX FITNESS Inc., its owners, employees, contractors, and affiliates from liability
-
Agree to indemnify and hold harmless YBX FITNESS Inc. against claims arising from your actions
No minors are permitted to access YBX FITNESS Inc. facilities.
8. Medical Representation
Before using YBX FITNESS Inc. facilities, you represent that you have no medical condition, injury, or impairment that would increase the risk of harm from exercise.
You assume full responsibility for your participation.
9. Proof of Membership
A valid state or federal-issued photo ID may be required for entry.
Membership privileges are non-transferable and limited to the individual named on the account.

Consent

Consent is not a condition of purchase.
Message Frequency
Message frequency varies based on account activity.
Opt-Out
You may opt out at any time by replying STOP to any message.
You will receive a confirmation message and will no longer receive SMS messages unless you opt back in.

13. Entire Agreement
This document constitutes the entire agreement between you and YBX FITNESS Inc. and supersedes all prior written or verbal agreements.
